March
20
,
1996
, the
day
following
the
election
, the
Post
Crescent
declared
incumbent
mayor
Richard
DeBroux
the
winner
by a
board-certified
margin
of
8
votes
in his
race
for
re-election
against
Tim
Hanna
(7,364
vs
.
7,355)
.
When
all
'
official
'
votes
were in,
however
, the
margin
reported
by the
Post
Crescent
on
March
28
,
1996
was
14
votes
with
Tim
Hanna
the
winner
. In that
recount
, the
Board
of
Canvassers
excluded
143
lost
and
later
found
ballots
(from
District
16)
and
listed
Hanna's
total
vote
count
at
7,298
against
DeBroux's
7,284
. "The
Board
of
Canvassers
-
City
Clerk
Cindi
Hesse
and
citizen
members
Thomas
Nooyen
and
James
Recker
-
certified
that
Hanna
won
the
recount
despite
City
Atty
.
Gregory
Carman's
recommendation
that the
votes
recorded
election
night
in the
16th
District
should have been the
ones
used
in the
recount
. Had those
votes
been
included
,
DeBroux
would have been the
winner.
"
Having
escaped
the
custody
of
Cindi
Hesse
, the
missing
ballots
were
found
at a
print
shop
among
thousands
of
unused
ballots
8
days
following
the
election
. On
April
3
, the
P-C
reported
DeBroux
submitted
to the
clerks
of
court
in
Outagamie
,
Calumet
and
Winnebago
counties
a
complaint
that
sought
to
overturn
the
election
certification
of
Hanna
as
victor
.
April
10

article
reported
Hanna
wanted
a
revote
in the
16th
District
whereas
DeBroux
contended
a
citywide
election
would be
better
. On
April
12
,
1996
, the
P-C
reported
'
DeBroux
is
the
likely
winner
'
after
Reserve
Judge
Robert
Parins
'
reversal
of the
Board
of
Canvassers
'
certification
of
Ald
.
Tim
Hana's
recount
victory
. On
April
13
,
P-C
reported
that in
response
to
Reserve
Judge
Parins
'
ruling
, the
certified
election
results
were
DeBroux
with
7,369
votes
and
Hanna
with
7,367
: a
margin
of
two
votes
. On
April
17
, the
P-C
reported
DeBroux
was
sworn
in for his
second
term
as
Mayor
.
Hanna
appealed
based
on a
handful
of
uncounted
votes
in the
16th
District
. On
May
10
, the
P-C
reported
Hanna's
appeal
would
go
to
court
in
Waukesha
.
Hanna
additionally
filed
an
appeal
against
Reserve
Judge
Robert
Parins
'
ruling
.
November
8
,
1996
, the
P-C
reported
that
Appleton
City
Atty
.
Greg
Carman
had
advised
City
Clerk
Cindi
Hesse
to
serve
on the
Board
of
Canvassers
for the
election
recount
despite
a
state
law
requiring
the
mayor
to
appoint
a
substitute
when
the
clerk
is
on the
ballot
for
re-election
. That
same
day
, the
P-C
reported
that
DeBroux
was
expected
to
announce
that he would not
challenge
an
appeals
court
ruling
that
awarded
the
March
19
election
to
Timothy
Hanna
. On
November
12
,
1996
, the
P-C
reported
that the
Board
of
Canvassers
recertified
Timothy
Hanna
as the
mayor
of
Appleton
,
setting
the
stage
for his
formal
swearing
in.
